RELEASE OF LIABILTY

This Agreement is entered into between FitByCallie LLC (“Trainer”) and individual recorded and/or signed below (“Client”). The provision of personal training services by Trainer to Client, and/or Client’s use of a program(s), instructional exercise video(s), or any information obtained from Trainer directly or indirectly upon this Agreement.

I agree that if I engage in any physical exercise or activity for any purpose, I do so at my own risk and assume the risk of any and all injury and/or damage I may suffer, whether while engaging in physical exercise or not. This includes injury and/or damage sustained resulting from use of any premises, facility, or equipment. I agree it is my responsibility to determine if it is appropriate to obtain advice from a medical professional prior to starting physical exercise or activity.
I agree on behalf of myself to release and discharge Trainer from any and all claims or causes (known or unknown) arising out of the negligence of Trainer, whether active or passive, or any of Trainer’s affiliates. This waiver and release of liability includes, without limitation, injuries which may occur as a result of (a) my use of any exercise equipment or facilities which may malfunction or break, (b) negligent instruction or supervision, including personal training.
I agree that I will not use any program(s), instructional exercise video(s), or information purchased from Trainer for personal training any other individual. I agree I will not publish/share any program(s), instructional exercise video(s), or any information purchased from Trainer on any media platform, website, app, or equivalent. I agree I will not replicate program(s), instructional exercise video(s), or any information purchased from Trainer and present it as my own or others’ for profit or not.
I acknowledge that I am of sound mind and body and have carefully read this waiver and release and fully understand that it is a release of liability, express assumption of risk and indemnity agreement. I have read and voluntarily signed the waiver and release and further agree that no oral representations, statements, or inducement apart from the foregoing written agreement have been made.
